Terms of service

These terms explain how purchases from Hameldown work. Please read them with the product information and our delivery, returns and privacy policies before placing an order. Nothing in these terms removes rights you have under applicable consumer law.
1. Who you buy from
Hameldown is operated by Nicholas Smith, a sole trader trading as Hameldown. Our business correspondence address is Hameldown, Bagpark, Widecombe in the Moor, Newton Abbot, TQ13 7TR, United Kingdom. You can email nickselecttradebrands@gmail.com or use our contact form.
Hameldown brings together products from partner brands. Your contract of sale is with Hameldown, not Shopify or a separate supplier. Partner brands may store, pack and dispatch the goods and help us investigate an enquiry or return. Hameldown remains your point of contact and responsible for its obligations as the seller.
2. Placing an order
Before placing an order, please check the product, selected design or colour, size or capacity, quantity and pack size. Photographs may show styling items or several products; only the items specified in the product description and your selected option are included. Please ask us before ordering if anything is unclear.
Provide accurate contact and delivery details and use a payment method you are authorised to use. You must be legally able to enter the purchase contract.
After you place an order, an order acknowledgement confirms that it has been received. Our acceptance takes place when we send a dispatch confirmation. If goods in the same order are dispatched at different times, acceptance of the order does not remove your applicable cancellation rights for separately delivered goods. If we cannot accept or fulfil an item, we will tell you promptly and refund any payment taken for that item and any applicable delivery charge without undue delay. Please retain your confirmation and these terms.
3. Products, availability and prices
We take reasonable care to describe products accurately. Screen settings can affect how colours appear. Where a product is described as hand-finished or hand-made, the listing may explain reasonable individual variation. These points do not excuse material differences, defects or a failure to match the description.
Stock availability can change while an order is being processed. We do not substitute a materially different product without your agreement. If an obvious error in a price or description is found before acceptance, we will explain it and let you decide whether to proceed on the corrected basis or receive a refund. We will not increase the price of an accepted order without your agreement.
Prices are in pounds sterling (GBP). Hameldown is not VAT registered and does not add VAT to your order or issue VAT invoices. The displayed product price is the amount payable for that product. Delivery and any other applicable charges are shown before you commit to pay. Discounts apply subject to the conditions stated when offered. You will not be charged an undisclosed optional extra.
4. Payment
Available payment methods are shown at checkout. Payment is processed using Shopify and the relevant payment provider. The timing of payment authorisation or collection is shown during checkout or in the payment provider's terms. For an eligible cancellation or refund, the rights described in our returns policy apply.
5. Delivery and responsibility for goods
Hameldown currently accepts orders for delivery within the United Kingdom only. Delivery to a particular UK address depends on the items, supplying brand and available delivery service. Regional restrictions and additional delivery charges, where applicable, are shown before you order. See our Delivery information for the current estimates and scope.
Delivery availability, charges and any service-specific timing are provided before purchase. Different partner brands may dispatch separate parcels. An estimated dispatch time is not the same as an arrival date. We pass through the delivery charges available for your basket through Shopify Collective at checkout. A free-delivery offer on a supplier's own website does not automatically apply to a Hameldown order.
Unless we agree a different delivery period with you before purchase, goods will be delivered without undue delay and within 30 days of the contract being made. If an essential agreed date is missed, delivery is refused, or a further appropriate delivery period you have allowed is missed, you may have the right to end the contract and receive a refund. Your statutory rights regarding late or failed delivery are unaffected.
We remain responsible for goods until they are physically received by you or a person you identify to receive them, other than the carrier. The legal exception for a carrier independently commissioned by you and not offered by us applies where relevant. We do not treat a tracking scan alone as conclusive proof that you have received the goods.
6. Cancellations, returns and faulty goods
For most online purchases, you may notify us of cancellation within 14 days after the day you receive the goods, and then have 14 days to send them back. The rules for an order delivered in separate parts and the limited exceptions are explained in our Returns & refunds policy. You also have separate rights if goods are faulty, incorrectly supplied, not as described or not fit for purpose.
Contact Hameldown, not just the carrier or manufacturer. A partner brand's internal policy cannot take away your statutory rights against us.
Our Bagpark address is for business correspondence, not parcel returns. Contact us for the correct return destination. This arrangement does not make cancellation conditional on permission or reduce any legal return route or remedy.
7. Our responsibility
If we break the contract or fail to use reasonable care and skill, we are responsible for loss or damage that was reasonably foreseeable as a result. We do not exclude or limit responsibility for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, your legal rights in relation to the goods, or any other liability that cannot lawfully be excluded or limited.
These terms are written for consumer purchases. We do not use them to exclude consumer rights because a partner brand handles fulfilment. If you need a trade or resale purchase, contact us to discuss the appropriate terms before ordering.
8. Website use and intellectual property
You may use the website to browse, purchase and contact us. Do not misuse it, try to gain unauthorised access, interfere with its operation or submit unlawful content. Website text, photographs, designs and brand assets belong to Hameldown, the relevant brand or other rights holders. Browsing or buying does not grant permission for commercial copying of those materials.
Links to another organisation's website are provided where useful. That organisation controls its own website and policies. Such links do not change our obligations for your Hameldown purchase.
9. Your information
We use personal information as explained in our Privacy policy. Necessary order information is shared with the brand fulfilling your items and with service providers involved in payment, delivery and customer support. Sending a contact-form enquiry does not subscribe you to marketing.
10. Questions and complaints
Email nickselecttradebrands@gmail.com, use our contact form, or write to Hameldown, Bagpark, Widecombe in the Moor, Newton Abbot, TQ13 7TR, United Kingdom. Please describe the problem and the outcome you are seeking. We monitor messages Monday to Friday, excluding UK bank holidays, and aim to reply within two working days. We will investigate, working with the relevant partner where necessary, and keep you informed if a full resolution takes longer. This response target does not extend a legal deadline or delay acknowledging an online cancellation. If we cannot resolve a complaint directly, we will explain any applicable next steps and provide alternative dispute resolution information where legally required. We do not claim membership of an ADR scheme unless that membership is confirmed.
11. Changes and governing law
The terms in force when you place your order apply to that order. We may update the website and these terms for future orders, but not retrospectively remove rights you already have. If a term is found unenforceable, the remaining terms continue to apply where lawful. You retain the protection of mandatory consumer law.
These terms are governed by the law of England and Wales, without depriving you of mandatory protections in your country of residence. Consumers in Scotland or Northern Ireland may also bring proceedings in their local courts. Nothing here restricts any other court rights you have under applicable law.
